Zeeto No Consent to Unwanted Text Messages TCPA Class Action

Zeeto, LLC, says the complaint for this class action, “is a business that offers digital marketing, permission[-]based advertising, and online advertising.” Unfortunately, the complaint claims it also engages in repeated text message telemarketing, in ways that violate the Telephone Consumer Protection Act (TCPA).

The complaint alleges, “Unfortunately for consumers, [Zeeto], in an attempt to secure more business, engage in an aggressive telemarketing campaign by repeatedly sending unsolicited, repetitive text message advertisements to consumer[s’] telephones using an automatic telephone dialing system (‘ATDS’)—often without consent and in violation of the law.”

Plaintiff Edwin Williams received a text message from a number he didn’t know in or around June 2020. The message contained a link to one of Zeeto’s websites, getitfree.us.

After that, he received numerous other text messages, all with the getitfree.us website and advertisements. A selection of some of them began:

  • “Hey edwin! You’re just a few steps away from getting new Milwaukee tools shipped to your doorstep…”
  • “Hungry edwin? Get Burger King chicken nuggets delivered straight to your door! Tap here…”
  • “Now’s your chance edwin! Get free samples of Gain Ultra Flings today. Redeem here…”
  • “Hey edwin, this offer hits it out of the park! Get a free Grand Slam at Denny’s! Tap here…”
  • “Father’s Day is just around the corner! Check out all our favorite freebies to help you celebrate Father’s Day…”

The complaint alleges, “All of the text messages were sent via an ATDS at the direction and oversight of [Zeeto]. [Zeeto] knew about, directed, ratified, and benefitted from the text messages.”

Williams, it claims, never gave his consent to receive text messages from Zeeto.

Two classes have been defined for this action:

  • The No Consent Text Class is all persons in the US (1) to whose cell phone (2) Zeeto (or another person acting on Zeeto’s behalf) sent text messages, between September 20, 2017 and September 20, 2021, (3) using the same dialing equipment used to text the plaintiff in this case, (4) to promote a product or service, and (5) from whom Zeeto claims to have gotten prior express consent in the same manner it got consent from the plaintiff in this case.
  • The DNC Registry Class is all persons in the US (1) who never authorized the sending of unsolicited text messages from Zeeto, and (2) to whom Zeeto (or someone acting on Zeeto’s behalf) sent at least two text messages in a twelve-month period, between September 20, 2017 and September 20, 2021, after the person replied “Stop,” “Bye,” or a substantially similar command, (3) where the person’s telephone number had been listed on the National Do Not Call Registry for at least thirty days (4) where the text messages were for the same purposes as the text messages to the plaintiff in this case, (5) from whom Zeeto claims it got prior express consent in the same manner it claims it got consent from the plaintiff in this case.
