Wells Fargo, Others Deny Access to Others’ Commercial Property Class Action

When United Furniture Industries, Inc. went out of business on November 21, 2022, the complaint for this class action alleges, it had commercial property owned by others on its property. The complaint alleges that those who have taken control of United Furniture’s property—Wells Fargo & Company, Wells Fargo Bank, NA, Focus Management Group USA, Inc., and Security Associations of Mississippi, LLC—have been denying access to the owners of this commercial property.

The class has not been defined in the complaint for this class action, but it is presumably all those who have commercial property situated on the property formerly owned by United Furniture Industries, Inc. or its subsidiaries, that is currently under the dominion and control of the defendants in this case, and who have been denied access to that commercial property by the defendants.

The plaintiff in this case, Atkins Trucking, LLC, is a Delaware corporation with its main place of business in San Francisco, California; it provides trucking services. Before United Furniture went out of business, before November 22, 2022, the complaint alleges, Atkins delivered furniture for United Furniture.

United Furniture went out of business on November 21, 2022, the complaint says, and ended all its operations. It alleges, “Upon information and belief, Defendants Wells Fargo & Company, Wells Fargo Bank, NA, and Focus Management Group USA, Inc. … have taken physical possession of the facilities owned by United Furniture Industries.”

The complaint also alleges that these three parties engaged Security Associates of Mississippi, LLC “to provide security services at all the facilities owned by United and under the dominion and control of the Defendants.”

Security Associates, the complaint claims, is now denying Atkins and others access to their commercial property which is located on United Furniture’s property. Thus, it says, the defendants in this case have taken wrongful possession of that commercial property that belongs to these others, with the rightful owners unable to regain possession. But the defendants, the complaint claims, do not have any security or other rightful interest in the commercial property they are keeping from its owners.

The complaint asks for injunctive relief, that is, an injunction that will forbid the defendants from continuing to deny access to the commercial property to its rightful owners and that will allow them to retrieve their property. It asks the court also to award the plaintiff “reasonable attorneys’ fees, costs, and expenses” as well as “any and all additional relief the Court may deem appropriate.”
