
The complaint for this class action alleges that Virtuoso Sourcing Group, LLC (VSG) is one more in the long list of companies making illegal calls to consumers, in violation of the Telephone Consumer Protection Act (TCPA). At issue are wrong-number autodialed calls made to consumer cells phones.
The class for this action is all persons in the US (a) to whom VSG placed a call (b) directed at a number assigned to a cell phone, but not to the actual recipient of the call (c) using an automatic telephone dialing system or an artificial or prerecorded voice, (d) between October 8, 2015 and the date of certification of the class in this case.
Congress passed the TCPA to try to give consumers some control over the barrage of telemarketing calls brought about by the availability of automated telephone equipment. Of particular concern were consumer cell phones, since cell phone owners typically pay for incoming as well as outgoing calls. This makes telemarketing not just a nuisance but an expense as well.
As it stands, it is unlawful for a company to place a non-emergency call to consumer cell phone using an automatic dialing system or an artificial or prerecorded voice unless the consumers have given their prior express written consent. Specifications also exist for how that consent may be obtained.
In this case, Ericka Taylor began receiving auto-dialed calls on her cell phone sometime around June 2018. When she picked up, she heard a period of “dead air” before the phone was connected to a VSG representative. When the representative came on the line, she asked for someone other than Taylor.
The complaint says that Taylor informed the representatives several times that she was not the person they were looking for and that she did not know that person. The calls came from two numbers. At least one of them, when called back, produced a voice that said, “You have reached Virtuoso Sourcing Group…”
Taylor believes that she told the representatives to stop calling her. However, the calls continued. Taylor cites calls made on June 7 and June 10, 2019, at 4:32 pm and 10:07 am, respectively.
According to the complaint, Taylor is not a customer or debtor of VSG’s clients; she has had no dealing with VSG. In fact, VSG was calling to reach someone other than Taylor.
The complaint alleges that the calls were made using an automatic dialing system.
