The National Do Not Call Registry Class is all persons in the US
- Whose telephone numbers were on the National Do Not Call Registry for at least thirty-one days,
- But who received more than one telemarketing call from or on behalf of Venture Solar,
- Within a twelve-month period,
- Between January 3, 2018 and January 3, 2022.
Venture Solar tries to sell its solar energy services people in various states, including those who live in Connecticut, New York, and Pennsylvania. Unfortunately, the complaint asserts, “To generate business through sales, Venture Solar relies on telemarketing.”
Telemarketing was not Venture’s first sales approach to the plaintiff in this case, Andrew Perrong. According to the complaint, “Venture Solar engages in residential door-to-door solicitation” and that it does so “without the permits required by law.”
The complaint alleges that Venture approached Perrong at his home on December 29, 2021, and that Perrong told the sales agent that he was not interested. However, the complaint alleges, “as the Venture Solar salesman would not identify himself and did not leave the property where Mr. Perrong was, Mr. Perrong contacted the Northampton Township Police Department, who dispatched an officer.” The officer who came told Perrong that he intended to cite the sales agent for not having a license.
After that, although Perrong says he did not give his number to the sales agent, the complaint alleges he began to get calls from Venture. Perrong’s number has been on the National Do Not Call Registry since November 2018.
The complaint alleges that Venture “placed telemarketing calls to [Perrong’s] number twice on December 30, 2021.” The complaint quotes the voicemail left in the first call, which begins, “This is Christian from Venture Solar. Hope all is well. I’m just reaching out in response to an inquiry made [sic]. It’s telling you about how much you save with solar energy for your home. I’ve got a quick question for you. So give me a call whenever you get this message…”
“Christian” also called again that day, the complaint alleges, offering Perrong solar items sold by Venture.
The complaint also quotes an ad allegedly placed by Venture, looking for a Remote Part Time Recruiting Outbound Caller.
