Toyota Supra Sports Coupe Long Waits for Repairs Maryland Class Action

This class action bring suit against Toyota Motor Sales USA, Inc. over the Supra sports coupe. The Supra’s chassis, transmission, and engine are currently made by BMW. The complaint for this class action alleges that when customers bring Supras for recalls or other repairs, they must wait for excessive periods of time, sometimes more than six months, before they can regain the full use of their vehicles.

The class for this action is all Maryland residents who bought the Supra sports coupe during the applicable statutes of limitations.

Toyota first manufactured the Supra between 1978 and 2002.

In 2019, it decided to reintroduce it, this time with the chassis, transmission, and engine made by BMW. The complaint alleges, “The Supra appeals to car enthusiasts who value performance and comfort.

According to the complaint, the Supra has been the subject of many recalls, “relating to radio, seatbelt and rear camera failures, headlight malfunctions and steering problems.” The complaint also speculates, “[u]pon information and belief,” that “there exist other issues with the vehicle which have not resulted in recalls but reasonably should have.”

But it’s not specifically the recalls the complaint is protesting against. It’s that the cars are not serviced within a reasonable period of time.

Why does this happen, with a company as large and established as Toyota? The complaint alleges, “The Toyota dealerships who sold or leased the vehicles presently lack the parts, equipment, and general familiarity with non-Toyota engines and transmissions[] which are necessary to address the issues related to this vehicle and for general issues related to the vehicle.” This leads to the excessive delays.

The Supra sells for around $50,000. The complaint alleges that “[t]he value of the Product … was materially less than its value as represented by” Toyota, and that Toyota would not have been able to sell it for such a high price if it had fully informed customers about the difficult in getting repairs and the long delays during which they would not have full use of the vehicles.

These delays, the complaint contends, existed before Covid-19 appeared in the US and they are not related to the pandemic. Rather, it says, “they are caused by [Toyota’s] sale of a Product without [a] necessary support system in place to account for customary issues faced by owners of any model of car.”

The counts include breach of contract, breaches of warranties, negligent misrepresentation, and violations of Maryland’s consumer protection law, among other things.
