Toyota 2020 Highlander Hybrid Fuel Tank Capacity Maryland Class Action

Toyota Motor Sales USA, Inc. markets 2020 Toyota Highlander Hybrids as having a 17.1-gallon fuel tank that can deliver a range of 616 miles. The complaint for this class action alleges that the claims are false, that the vehicle will not accept anywhere near 17 gallons of fuel, and that it therefore has a rage of only 430-500 miles.

The class for this action is all persons who bought or leased one of the Highlanders at issue in Maryland.

It even advertises the vehicles with the statement “Best-in-Class 35 Estimated Combined MPG.” The complaint quotes a video ad for the Highlander as saying that drivers can “[g]o the extra mile” with the vehicle. Because of the increased range and efficiency, the complaint claims, the price of the Highlander Hybrid is almost $4,000 more than the non-hybrid version. Still, the complaint claims that the range of the Hybrid model is similar to or sometimes even less than the non-hybrid model.

The plaintiff in this case, Anan Said, bought a 2020 Highlander Hybrid in April 2020, believing that it had a fuel tank capacity of 17 gallons and could travel around 600 miles on a single tank of gas. Said travels between Pennsylvania, Washington, DC, and Massachusetts, the range claims were meaningful to him. However, once he had bought the vehicle, he found that it would only accept 12 to 13 gallons of gas, even when the tank is nearly empty.

The complaint points to complaints of the same problem at the National Highway Traffic Safety Administration (NHTSA) website. It quotes some of them:

  • “My new 2020 Highlander Hybrid has a big issue with the gas tank. I get only 460 miles, even if I top it off with the gas spewing out…”
  • “…I am not able to fill the tank by more than 12 gallons thus reducing my range to 420 miles. I believe there is a defect in the newly designed saddle tank…”
  • “…Nothing adds up to 17.1 gal of fuel in the tank. Going beyond the 1st click is bad for the system, yet only fills the car up to 7/8 full on the fuel gauge.”

The complaint alleges that Toyota knew about the problem at least by April 2020 and did not warn prospective purchasers. Furthermore, it claims that the company is having the same problem with 2019-2020 RAV4 Hybrids, which also cannot be filled as far as their advertised 14.5-gallon capacity.

According to the complaint, Toyota should issue a technical service bulletin to its dealerships about the problem, should tell prospective customers about the problem, and should remedy the defect.
