Think! Protein Bars Contain GMOs Class Action

Glanbia Performance Nutrition, Inc., which does business as think!, makes nutritional protein bars. The complaint for this class action alleges that all of the bars sold in the US are labeled as either “GMO Free” or “Non-GMO,” but it also claims that the bars are in fact are made with genetically-modified foods. The counts include negligent misrepresentation, fraud, and violations of consumer protection laws.

Genetically-modified crops are those for which the genetic material has been altered with genetic engineering techniques. Many consumers prefer to avoid GMO foods because they believe that non-GMO foods are healthier and more environmentally-friendly. The complaint alleges that “the market for all natural foods has grown rapidly in recent years, and [think!] seeks to take advantage of this trend through false advertising.”

The complaint claims that the company’s protein bars “are in fact loaded with ingredients derived from GM-crops such as corn, soy, and sugar beet, and many of [think!’s] Products also contain protein and/or dairy sources derived from cows raised on GMO feed. [think!’s] Products also contain numerous artificial ingredients that were genetically engineered in a laboratory setting using biotechnologies.”

According to the complaint, approximately 92% of the US corn crop, 94% of the US soybean crop, and 95% of the US sugar beet crop are GMO. The complaint claims that any products that contain domestic canola, corn, peas, rice, soybeans, or sugar beets are highly likely to contain GMO ingredients. The complaint also claims that many of the other ingredients of the protein bars are synthetic or highly processed.

The class for this action is all persons in the US who, within the applicable statutes of limitations up to the date of final judgment in this action, bought any of the products at issue. California and New York Subclasses have also been defined for those who bought the products in those states. The products are the following:

  • hink! High Protein Bar, Coconut Cake
  • think! High Protein Bar, White Chocolate Flavor
  • think! Protein+ 150 Calorie Bar, Chocolate Almond Brownie
  • think! Protein+ 150 Calorie Bar, Salted Caramel
  • think! Protein+ 150 Calorie Bar, S’mores
  • think! Protein+ 150 Calorie Bar, Cupcake Batter
  • think! Protein+ 150 Calorie Bar, Chunky Chocolate Peanut
  • think! Protein+ 150 Calorie Bar, Chocolate Chip
  • think! Keto Protein Bar, Chocolate Peanut Butter Pie
