
Terminix International Company, LP is “one of the largest pest control companies in the world[,]” according to the complaint for this class action. Unfortunately, the complaint also claims that Terminix violates the Telephone Consumer Protection Act (TCPA) in the way it seeks customers, calling them on their cell phones.
On or around May 5, 2020, plaintiff David L. Wilson placed a call to Terminix, asking for a price quote for its services. He spoke to a representative and got the quote he requested. However, he decided that he was not interested in using the company’s services and he told the representative so.
Sometime after that, even though he had told the company that he was not interested in its services, Terminix began calling him on his cell phone. Wilson is the sole owner and subscriber for the phone. Wilson had not given Terminix his consent to receive telemarketing calls.
When Wilson answers some of the calls, the first thing he hears is a significant pause, before he is connected with a live person. When he answers other calls, the first thing he hears is a prerecorded voice telling him to press a certain key to speak to a live person. The complaint alleges that the calls were made for the purposes of marketing Terminix’s services.
Because the calls were so frequent, the complaint says, Wilson asked Terminix to stop calling him. However, according to the complaint, Terminix has ignored the request and has continued to call him, sometimes placing multiple calls to him in a single day.
The complaint alleges that Terminix has place at least twenty-three calls to Wilson after he asked the company to stop calling.
As if that weren’t enough, Terminix also sent Wilson an e-mail on or around June 12, 2020, also with the purpose of marketing its services.
The complaint defines its class as being composed of two subclasses.
The Prerecorded Messages Subclass for this class action is all persons living in Missouri to whose cell phones Terminix placed marketing calls, using prerecorded messages, without getting prior express consent, between June 22, 2016 and the date of class certification in this case.
The Automatic Telephone Dialing System Subclass is all persons living in Missouri to whose cell phones Terminix placed marketing calls, using an automatic telephone dialing system, without getting prior express consent, between June 22, 2016 and the date of class certification in this case.
