Telecom Companies Facilitate Robocall Fraud TCPA Class Action

Telemarketing calls are a nuisance to most consumers. But the complaint for this class action alleges that a group of defendants are also sending or facilitating robocalls to defraud consumers. The group includes Ecommerce National, LLC, doing business as TollFreeDeals.com, SIP Retail, LLC, doing business as SipRetail.com, Global Voicecom, Inc., Global Telecommunication Services, Inc., KAT Telecom, Inc., IP Dish, and three individuals who own or control these companies.

The class for this action is all persons who received robocalls via the defendants’ telecommunications services between January 29, 2016 and January 29, 2020.

The complaint outlines a number of scams that have allegedly operated via the robocalls:

  • Social Security Administration (SSA) scam: The message claims that the individual’s social security number “has been used in criminal activity, the individual’s Social Security benefits will be suspended, the individual has failed to appear before a grand jury and face[s] imminent arrest, or the individual’s social security number will be terminated.”
  • Internal Revenue Service (IRS) or Treasury scam: The message claims that the individual “has been implicated in tax fraud, the individual has avoided attempts to enforce criminal laws, the individual has avoided court appearances, or the individual faces imminent arrest.”
  • US Citizenship and Immigration Services (USCIS) scam: The message claims that the individual “has failed to fill out immigration forms correctly, the individual faces imminent arrest or deportation, that the individual’s home country has taken formal action that may result in deportation, or the individual has transferred money in a way that will result in deportation.”

Other alleged scams include impersonating foreign governments or tech support people from major companies such as Microsoft or Apple.

In each case, when the individual calls back or connects to a company representative, the complaint alleges, the representative directs the individual to submit a sum of money—for example, to transfer money to SSA “for safekeeping,” to transfer funds to the IRS to resolve the tax problem, or to pay fees or fines to avoid immigration consequences.

The complaint also claims that the numbers for the robocalls are “spoofed” so that they appear to originate from parties such as the US federal government.

According to the complaint, the robocalls originate overseas and are dependent on VoiP and related technology. The complaint says, “A foreign call center or telecommunications company that places VoiP calls to U.S. telephones must have a relationship with a U.S. gateway carrier.” For this reason, the complaint says, “[o]ne of the Defendants’ roles in the fraudulent schemes is to serve as a gateway carrier for the fraudulent robocalls.”

The complaint claims that the companies are aware of the fraudulent nature of the calls they facilitate, and knowingly cooperate with the scams. In fact, the complaint claims that they specifically market their services foreign call centers who want to transmit robocalls to US numbers.
