Telebrands Silver Bullet “Durable” Expanding Hose Class Action

Telebrands Corporation advertises the expandable Silver Bullet garden hose as having a “durable outer shell” that doesn’t “snag, tear, or wear,” but the complaint for this class action alleges that these representations are far from the truth. On the contrary, the complaint alleges that the hose wears, tears, or bursts in a short period of time.

The Nationwide Class for this action is all individuals and entities in the US who bought Silver Bullet Hoses, not directly from Telebrands, that were developed and marketed by Telebrands. A California Class has also been defined, for individuals and entities in California.

Telebrands is a direct television marketing company that advertises and sells consumer products. It markets the Silver Bullet Hose as a “pocket hose” or a compact hose that expands to a normal size, when used, to a length of twenty-five, fifty, seventy-five, or a hundred feet. Telebrands claims that the hoses have a “durable outer shell” and that the hoses’ “exclusive Bullet Shell outer casing won’t snag, tear, or wear.”

The complaint reproduces an image from the promotional material or packaging, headed, “Compact, Lead-Free, and Super-Durable—It’s the ONLY Hoose You’ll Ever Need.” It comes with “lead-free aluminum connectors” and a “free turbo nozzle.”

Plaintiff Christopher Rash saw an infomercial about the Silver Bullet Hose. The promises about the Bullet Shell made Rash believe that the hose would be durable and long-lasting. He bought the actual hose online at Amazon, a twenty-five foot version for which he paid $19.99.

The complaint alleges, “Mr. Rash believes the hose he purchased lasted for approximately four (4) weeks before fraying, wearing out, developing pin-holes, and leaking. Mr. Rash estimates that he used the hose fewer than 10 times.”

Rash wanted to return the hose, but Amazon would not take the return; it told him to return it to the manufacturer, Purple Cow CSJ, LLC. However, the complaint says, that company, “made it so difficult and burdensome that he ultimately gave up.”

Rash published two photos on Amazon’s website of the hole in the hose with a steady stream of water squirting through it and posted a review, entitled, “The single jacket covering the rubber hose wears easily causing rubber hose to burst.” The review said, among other things, “I noticed that the single jacket sheath that is wrapped around the interior rubber hose[] easily began to fray while being drug [sic] across the concrete, causing the interior rubber hose to be exposed and burst.”

He added, “The nozzle worked well at first, but after each use, the effectiveness of the stream became less and less, to where it could not maintain a consistent straight stream.”

The complaint alleges that Telebrands has been aware of the hose’s defects since at least 2009, because of three previous class actions filed on similar claims and because of numerous other online product reviews.
