Southern California Edison TCPA Class Action Lawsuit

This class action lawsuit claims that Southern California Edison violated the Telephone Consumer Protection Act (TCPA) by using an automatic-capable dialer to make unsolicited calls to consumers’ cell phones without consent.

            Southern California Edison is the primary electricity supply company for much of California.  Recently, it has engaged in the practice of pushing incentives offered through the California Solar Initiative by making unsolicited calls to individuals’ cellular phones without consent.  The TCPA strictly forbids intrusive phone calls to private cellular phones, placed to numbers obtained without the prior express consent of the call recipients.  Southern California Edison deliberately and willingfully violated the TCPA in order to try to push their solar program.

            The plaintiff in this lawsuit, Michele Hunt, is a resident of California.  Beginning in September 2016, she began receiving a number of unsolicited phone calls to her cell phone that she did not consent for.  In total, she received 7 calls.  The numbers that contacted her were 880-655-4555 and 800-684-8123.  When the calls came in, there would be a short delay before Hunt would connect to a live representative.  Once connected, the representative would solicit Hunt to schedule an appointment to have an agent evaluate her home for solar panels.  Numerous times, during these same calls, she would instruct the representative to stop calling and that she was not interested.  She continued receiving calls from Southern California Edison.  These calls were placed to Hunt using an automatic telephone dialing system in which numbers were selected and dialed randomly from a large list of numbers.  The use of an automatic telephone dialing system is evidence of a much wider system of calls.

            Based on the facts of the case, the plaintiff alleges the Southern California Edison violated the TCPA by using an automatic-capable dialer to make unsolicited calls to cell phones across California.
