This settlement resolves two consolidated class actions alleging that Wells Fargo Bank, NA did not pay proper compensation to its Home Mortgage Consultants, Private Mortgage Brokers, and others (HMCs) working for it in California. The complaints alleged that Wells Fargo did not provide proper rest periods, vacation pay, and minimum wage for all hours worked. The case is intended to have Wells Fargo cover premium pay for missed rest periods, unpaid vacations, minimum wages, and civil and statutory penalties. Some amounts have already been paid in the settlement of the Ibarra case.

Eligibility:

You may be eligible if you were employed by Wells Fargo Bank, NA in California as a Home Mortgage Consultant, Home Mortgage Consultant Jr., Private Mortgage Banker, or Private Mortgage Banker, Jr., at any time between March 17, 2013 and December 31, 2019.

Typical Settlement Amount:

(1) Ninety percent of the net settlement fund will go for rest period claims. Pro rata shares will go to class members based on the number of days each entered at least 3.5 hours in the timekeeping system between March 17, 2013 and March 31, 2018. Amounts will be offset by any amounts already received in the Ibarra settlement. (2) Ten percent will go for other claims. Pro rata shares will go to class members based on the number of days worked between October 27, 2013 and December 31, 2019.

Total Settlement Amount: $95,696,122.35, including the Ibarra case settlement amount
