Eligibility:

You may be eligible if you had an Encompass policy issued in Washington and Encompass paid to have your vehicle repaired under its UIM PD coverage, and

  • The accident occurred between July 28, 2009 and March 10, 2017,
  • The repair estimate totaled at least $1,000,
  • Your vehicle was no more than six years old (model year plus five years) and had less than 90,000 miles on it at the time of the accident, and
  • Your vehicle suffered damage to its structure or deformed sheet metal, or required body or paint work.
Typical Settlement Amount:

Varies, but expected to be several hundred dollars. Awards will be figured by a formula using your repair costs, total repair costs of all class members, and the portion of the settlement paid to class members. Not everyone who received a notice will be eligible to receive an award.
