Case Summary:

Encompass Insurance has agreed to a settlement in a case alleging that it did not take all damage into account with accident payouts. The complaint claims that when certain cars have damage to their structural systems and bodies, they can never be returned to their pre-accident condition, and that this damage causes a diminishment in value. Encompass, the complaint alleges, failed to pay adequately for this loss under its Washington policies’ uninsured or underinsured motorist property damage (UIM PD) coverage, which the complaint claims is a breach of insurance policy contracts.
