Case Summary:

The state of Washington’s Department of Social and Health Services (DSHS) is putting up $116 million to settle a class action alleging that it did not pay certain individual providers (IPs) of services all the wages they were owed. The complaint alleged that DSHS reduced paid care hours because it found that certain clients shared the benefit of having certain tasks provided for them, such as making meals, shopping, doing housework, or supplying wood. The complaint claimed that these workers are now owed back wages for the times they worked without pay.

Eligibility:

You may be eligible if you are a current or former IP who contracted with DSHS to provide personal care services for a client whose in-home care hours between March 7, 2014 and February 28, 2021 were reduced because DSHS used a code for the client in a CARE assessment that indicated a shared benefit for one or more of the instrumental activities of daily living.

Typical Settlement Amount:

Pro-rata share of the net settlement fund ($105 million) based on the number of hours you worked without pay and the rate of pay for those hours. Payroll taxes and union dues will be withheld and paid as necessary.
