Case Summary:

Verified Credentials, Inc. is settling a class action alleging that it violated the Fair Credit Reporting Act. The complaint alleges that, in consumer reports for employment purposes, the company reported public-record information likely to have an adverse effect without providing notice of this to the subject of the report and without maintaining strict procedures to ensure that the information in the report was complete and up-to-date. (A second defendant in the same suit is not participating in this settlement.)

Eligibility:

You may be eligible if you are in either of two classes.

Automatic Payment Class: All natural persons living in the US,

  • Who were the subject of a consumer report sold by Verified for employment purposes. between February 24, 2014 and January 24, 2016,
  • Whose report contained at least one public record of a criminal conviction, civil lien, bankruptcy, or civil judgment that was likely to have an adverse effect on the subject’s ability to obtain employment,
  • Who then disputed the information with Verified,
  • Whose dispute resulted in a revised report,
  • Where no notice was sent to the subject as required under the FCRA.

Persons in this class who have received notices are not required to opt-in to the class.

Opt-In Class: All natural persons living in the US,

  • Who were the subject of a consumer report sold by Verified for employment purposes. between February 24, 2014 and January 24, 2016,
  • Whose report contained at least one public record of a criminal conviction, civil lien, bankruptcy, or civil judgment that was likely to have an adverse effect on the subject’s ability to obtain employment,
  • Where no notice was sent to the subject as required under the FCRA, and
  • Who timely opts in and completes and submits a valid claim form certifying that they consumer report was incomplete or not up-to-date, and who claims they were harmed as a result.

People in this class must submit an opt-in notice.

Typical Settlement Amount:

Pro rata share of the net settlement; estimated at between $19.07 and $256.00, depending on how many valid claims are received.
