Case Summary:

USAA has settled a class action alleging that, when its auto insurance companies calculated Actual Cash Value payment amounts on totaled cars, they sometimes did not properly figure in the sales tax. Actual Cash Value payments are based on the estimated amount it would cost at the time to buy a comparable vehicle, minus any deductibles.

Eligibility:

You may be eligible if:

  • You were insured by one of the companies named under an auto insurance policy;
  • You suffered a covered total loss between October 17, 2008 through October 15, 2016; and
  • You received from the company an Actual Cash Value Payment for the covered total loss.

You may not be eligible if you previously filed a lawsuit for similar claims or gave the company an executed release during the class period. See the Notice for more information on exclusions.

Also, not everyone who received such a payment failed to receive the correct sales tax amount. Plaintiffs’ counsel have calculated that approximately 30% of people who received payments received the correct amount, while approximately 70% did not.

Varies; may be more than $450. Calculated as full ACV sales tax for totaled vehicle; minus the amount of sales tax included in payment; plus an additional 8%.
