Case Summary:

The University of Southern California (USC) and its Board of Trustees and Dr. George M. Tyndall, MD, have arrived at a $215 million settlement in several combined class actions relating to Tyndall’s behavior with patients at the USC Student Health Center. The complaints claimed that Tyndall committed medical malpractice in allegedly sexually assaulting, abusing, and engaging in harassing and offensive behavior with female patients who came to see him for women’s health issues. Also, plaintiffs claimed that USC supervisors were repeatedly told of Tyndall’s behavior but did not take adequate measures to protect patients.

Tier 2 and Tier 3 claimants will need to submit details of their encounter(s) with Tyndall and undergo a panel review. Tier 3 claimants will also be interviewed by a specialist. Claimants who were not pre-identified must prove they were students or provide other evidence of class membership.


You may be eligible if you are a woman who was seen by Dr. George M. Tyndall at the USC Student Health Center between August 14, 1989 and June 21, 2016 (a) for women’s health issues, or (b) whose treatment by Tyndall included his examining her breast or genital areas, or (c) whose treatment included his taking photos or videos of her partially-clothed or unclothed body. (The term “women’s health issues” includes any issue related to breast, vaginal, urinary tract, bowel, gynecological, or sexual health, including contraception and fertility.) 

Typical Settlement Amount:

Tier 1: $2,500. Tier 2: $7,500-$20,000. Tier 3: $7,500-$250,000. All class members will receive the Tier 1 benefit. Tiers 2 or 3 are additional payments and may be reduced depending on the number and nature of valid claims received. USC will also introduce policies to prevent abuse and sexual violence on campus.
