Case Summary:

The defendants in this class action—Sovran Self Storage, Inc., Sovran Acquisition, LP, Uncle Bob’s Management, LLC, (collectively now Life Storage, Inc.)—are putting up $8 million to settle a class action alleging that they New Jersey consumer protection and other laws. The complaint claims the Uncle Bob’s Rental Agreement, the associated Insurance Participation Form, and the Notice to Vacate all have provisions that violate the New Jersey Truth-in-Consumer-Contract Warranty and Notice Act (TCCWNA) and the New Jersey Consumer Fraud Act (CFA). According to the complaint, Sovran engaged in the unlicensed sale of insurance and did not provide a copy of the insurance certificate to the plaintiff; the insurance was “phantom coverage” that did not cover mold- or mildew-related losses; and the premiums were unconscionably high.

Eligibility:

You may be eligible if you are a member of either of the following classes:

  • TCCWNA Class: All persons who entered into a rental agreement with the defendants in this case in New Jersey, between January 1, 2011 and March 9, 2016.
  • CFA Class: All persons who bought insurance coverage from Bader Company/PMAIC through the defendants in this case in New Jersey, between January 1, 2011 and January 31, 2018.

You may be a member of both classes and qualify for both payments. You do not need to submit a claim form. 

Typical Settlement Amount:

(1) TCCWNA Class: payment estimated at $43.97 for each self-storage rental transaction. (2) CFA Class: approximately 33% of total amount of premiums paid for Bader insurance. Also, as of February 1, 2018, Life Storage in New Jersey will no longer collect a monthly billing fee or receive administrative fees pertaining to Bader insurance.
