Case Summary:

Uber is settling a class action alleging that when it performed background checks on prospective drivers, it violated the federal Fair Credit Reporting Act (FCRA) as well as related state laws. The complaint for the case claims that Uber did not provide proper notice that it was intending to get a background check, did not obtain proper authorization, and did not give subject copies of the reports and required information before taking negative actions.

Eligibility:

You may be eligible if Uber requested a background check on you before January 3, 2015, in connection with your desiring to use the Uber App as a driver or “independent transportation provider.”

Class members will be dividing into two subgroups.

  • The ADR Group consists of class members who accepted an arbitration provision.
  • The Court Group consists of class members who did not accept or opted out of the arbitration provision. 
Typical Settlement Amount:

Estimated at $27 (for the ADR Group) or $62 (for the Court Group), depending on how many valid claims are received. Those who submit printed claims forms will be mailed a check. Those who submit electronic claims forms may choose to be paid by mailed check, PayPal deposit, or digital check/direct deposit. If you submit and electronic claim form and don’t choose a method, you will be mailed a check
