Case Summary:

Twilio, Inc., a cloud communications service company, is settling a call- and text-recording class action for $10 million. Twilio provides cloud communications services, including for customers Handy, Homejoy, and Trulia. The complaint alleged that the company violated the California Invasion of Privacy Act (CIPA) by intercepting and recording calls and text messages for Handy and Homejoy and text messages for Trulia, without first getting the consent of California citizens who were also on the calls.

  • Made or received a phone call that Twilio recorded for an account linked to Homejoy, between April 21, 2010 and March 31, 2016;
  • Made or received a phone call that Twilio recorded for an account linked to Handy, between April 21, 2010 and June 29, 2017;
  • Sent or received a text message that Twilio recorded for an account linked to Homejoy, between April 21, 2010 and March 31, 2016;
  • Sent or received a text message that Twilio recorded for an account linked to Trulia, between April 21, 2010 and April 26, 2018; and/or
  • Sent or received a text message that Twilio recorded for an account linked to Handy, between April 21, 2010 and April 26, 2016.

This is the CIPA § 631 Class. The CIPA § 632.7 Class is all such persons who, while in California, did any of the above using a cell phone.

Typical Settlement Amount:

Estimated at $64.30 per recorded phone call and $8.04 per recorded text message. Final amounts may change as allocation of the settlement fund is finalized.
