Case Summary:

All Nippon Airways Company, Limited (ANA) was the last holdout in a class action against thirteen airlines for conspiring to fix prices on transpacific travel and on fuel surcharges for such travel. It has now agreed to pay $58 million to settle its portion of this case. The other defendants, who participated in two previous settlements, include Air New Zealand Limited; China Airlines, Ltd.; EVA Airways Corporation; Philippine Airlines, Inc.; Cathay Pacific Airways Limited; JAL; Malaysian Airline System Berhad; Qantas Airways Limited; Singapore Airlines Limited; Societe Air France; Thai Airways International Public Co., Ltd.; and Vietnam Airlines Company Limited.

You may be eligible if you are a member of any of these three classes.

  • Japan Class: All persons and entities who directly bought tickets that included a fuel surcharge, from JAL or ANA for passenger air travel that originated in the US and included at least one flight segment from the US to Japan, between February 1, 2005 and December 31, 2007. 
  • Satogaeri Class: All persons and entities who directly bought satogaeri fares from JAL or ANA which originated in the US, included at least one flight segment to Japan, and did not include travel to any other countries, between January 1, 200 and April 1, 2006.
  • Settlement Class III: All persons and entities who directly bought passenger air travel originating in the US that included at least one flight segment to Asia or Oceania from or on any of the defendant airlines, between January 1, 2000 and December 1 2016.

Typical Settlement Amount:

Pro-rata share of the net settlement fund. Payment for Class III is estimated at $5 per ticket, but final amounts will depend on the number of tickets in all valid claims received.
