Closed Settlement Statement:

According to court documents, the claim submission deadline has passed. Please contact the claims administrator if you have any questions.

Case Summary:

TouchTunes provides digital jukebox services and also runs a mobile app that allows user to buy credits to play songs on its digital jukeboxes. However, other persons, such as the staff at the location of the digital jukebox, may use a remote control to skip songs that users have requested, and the complaint alleges that TouchTunes owes something to users whose choice was paid for but skipped.

Class Period: May 30, 2010 to October 28, 2013

Objection Deadline: April 6, 2018

Eligibility:

You may be eligible if, between May 30, 2010 and October 28, 2013, you bought credits to play a song through TouchTunes mobile app that was not played because it was skipped by a person using a TouchTunes remote control on a TouchTunes digital jukebox.

If your song was skipped between May 30, 2010 and October 21, 2012, and you did not receive a refund for the skipped song, you are a Claim Credit Subclass member and must file a claim form. If your song was skipped between November 1, 2012 and October 28, 2013, you do not need to file a claim; you are an Automatic Credit Subclass member and will automatically receive one TouchTunes credit, sent to the e-mail address associated with your TouchTunes account.

You may be a member of either class, but not both. Individuals who used cash, debit cards, or credit cards to buy credits to play songs directly from TouchTunes digital jukeboxes are not included in the settlement.

The settlement also requires that TouchTunes’ Terms of Use specify that user’s songs may be skipped due to “the ability of venue staff to skip a song.”
