Eligibility:You may be eligible if, between May 30, 2010 and October 28, 2013, you bought credits to play a song through TouchTunes mobile app that was not played because it was skipped by a person using a TouchTunes remote control on a TouchTunes digital jukebox.
If your song was skipped between May 30, 2010 and October 21, 2012, and you did not receive a refund for the skipped song, you are a Claim Credit Subclass member and must file a claim form. If your song was skipped between November 1, 2012 and October 28, 2013, you do not need to file a claim; you are an Automatic Credit Subclass member and will automatically receive one TouchTunes credit, sent to the e-mail address associated with your TouchTunes account.
You may be a member of either class, but not both. Individuals who used cash, debit cards, or credit cards to buy credits to play songs directly from TouchTunes digital jukeboxes are not included in the settlement.
The settlement also requires that TouchTunes’ Terms of Use specify that user’s songs may be skipped due to “the ability of venue staff to skip a song.”
