Celgene is settling, for the second time, an antitrust class action alleging that it took action to prevent or delay the entry of cheaper generics to the market. The complaint alleged that consumers and third-party payors were forced to pay higher prices for than they would have had generics been available.

Celgene was able to rescind a 2019 settlement when a number of entities opted out. This is a new settlement designed to replace the earlier one.

You may be eligible if you paid for thalomid or revlimid as a consumer or third-party payor (such as a health benefit plan) in California, the District of Columbia, Florida, Kansas, Maine, Massachusetts, Michigan, Nebraska, New York, North Carolina, Oregon, Pennsylvania, Rhode Island, or Tennessee, at any time before May 20, 2020.

If you submitted a claim form for the previous settlement, you do not need to submit another. However, you might want to submit a Supplemental Claim Form.

Share of the net settlement fund. Amounts will depend on the amount of money spent by each class member on purchases of the drugs and the total amount spent by all class members.
