Case Summary:

Telenav, Inc. has agreed to pay a total of $3,500,000 to settle a class action alleging that it violated the Telephone Consumer Protection Act (TCPA) in two ways. First, the complaint says that the company sent text messages to consumers’ cell phones without their prior express consent, encouraging them to download the “Scout” mobile app. Second, the complaint also claims that Telenav continued to send text messages to consumers’ cell phones even after they had sent Stop responses to the messages.

  • No Consent Subclass: US residents who, between July 28, 2012 and March 5, 2018, received at least one text message with a link to http://scoutgps.com and the language “Download Scout to send notifications,” “Connect with [NAME] by downloading Scout,” “To see [NAME]’s progress and communicate, download Scout,” or “Welcome to Scout! [NAME] is using Scout to talk about, plan, and navigate to Meet Ups.”
  • STOP Subclass: US residents who, between July 28, 2012 and March 5, 2018, received at least one additional text message other than a message confirming an opt-out request after replying STOP, QUIT, END, CANCEL, or UNSUBSCRIBE to any text message received from any Telenav Number on the list.

Typical Settlement Amount:

No Consent Subclass: One award unit up to a maximum of $1,500. STOP Subclass: Five award units, up to a maximum of $7,500. Members of both: Total of six award units, up to a maximum of $9,000. Final amounts will depend on the number of valid claims received.
