Case Summary:

Team Health, LLC (formers Team Health, Inc.) and Paragon Contracting Services, LLC are spending $15 million to resolve a class action about whether they properly compensated emergency medicine doctors for Supervisory Relative Value Units (RVUs) according to their independent contractor or employment agreements, between 2014 and the time when Variable RVU Compensation Plans were put into use. The complaint alleged that, until this time, Team Health and Paragon underpaid Supervisory RVUs. The Variable RVU Compensation Plans were implemented between 2018 and 2019 and laid out in more explicit terms when doctors did and did not get credit for supervisory RVUs.

Eligibility:

You may be eligible if you are an emergency medicine physician in the US who participated in one of the defendants’ operating affiliates’ RVU incentive plans between 2014 and the date you executed a new contract with a Variable RVU Compensation Plan, whether you were an independent contractor or an employee, if you had Supervisory RVUs associated with your name as a primary or secondary provider, but you were not paid for some or all of those RVUs under the relevant RVU incentive plan.

Note that some plans are excluded. You are not a member of the class (1) if you were enrolled in a “pool plan,” “tiered plan,” or a plan where all RVUs were determined at the “sole discretion” of the Team Health and Paragon; (2) if you were working at a facility where Team Health or Paragon paid all RVUs, regardless of type; or (3) if your plan excluded one or more types of Supervisory RVUs. You may be a member of the class if you participated in more than one type of RVU incentive plan during the class period, although you will not be paid for claims for contracts of one of the above types, or to the extent that you filed similar complaints or claims against Team Health, Paragon, or their affiliated companies.
