TD Bank is settling a class action alleging it unfairly charged accountholders Retry NSF Fees. An NSF fee is one that is charged for an Automated Clearing House (ACH) or check transaction that was submitted by a merchant and returned unpaid by the bank because the account did not contain sufficient funds. A Retry NSF Fee is a fee charged if the merchant again submits the same item and the bank returns it a second time insufficient funds.

Typical Settlement Amount:

The settlement offers cash payments and debt forgiveness. You can receive a portion of the net settlement fund, based on a formula in the Settlement Agreement for each Retry NSF Fee you were charged and paid. The more Retry NSF Fees you paid, the greater your settlement benefit will be. If you were charged Retry NSF Fees but did not pay them because your account was closed with a negative balance, the amount you owe will be reduced by a portion of your debt from the amount allocated for forgiveness. You may be eligible for both a cash payment and debt forgiveness if you paid some fees but did not pay others.
