Case Summary:

Shorter University is settling a class action alleging that the personally identifiable information (PII) and protected health information (PHI) of certain current and former students was stolen or exposed because of a September 2014 theft of documents at the Winthrop-King Centre on Shorter’s campus. The complaint claims that Shorter did not adequately protect the information and that it did not report the data breach immediately.

You may be eligible if your personally identifiable information or protected health information was stolen or compromised as a result of the September 2014 theft of documents at Shorter University’s Winthrop-King Centre.

The settlement provides for monitoring of identity theft plus reimbursement of losses related to the data breach of up to $175. These losses may include the following:

  • Unauthorized, unreimbursed charges on credit or debit cards.
  • Costs of addressing identity theft or fraud.
  • Losses caused by restricted access to funds.
  • Preventative costs, such as paying for credit monitoring, placing security freezes on credit reports, or obtaining credit reports for review.
  • Losses caused by e-mail fraud, such as phishing scams.
  • Late fees or fees for declined payments, overdrafts, returned checks, customer service, card cancellation, or card replacement.
  • Any other losses that can be fairly traced to the Shorter data breach.

You must have documentation for these losses, and can be reimbursed for losses of time that can be documented, for up to five hours of lost time, at $15 per hour. If you can document the losses but not the time, you can self-certify for up to two hours. You cannot self-certify for loss of time if you do not have documentation of the losses.

Typical Settlement Amount:

Up to $175 in documented losses plus losses of time; plus twelve months of free Identity Guard Total Protection identity monitoring services.
