Seterus, Inc. and Nationstar Mortgage, LLC will be paying $7 million to settle a class action alleging that they unlawfully threatened homeowners with foreclosure in a Notice of Default letter or Final Letter. The complaint alleged violation of the (1) the Fair Debt Collection Practices Act (FDCPA), the Michigan Regulation of the Collection Practices Act, (3) the North Carolina Debt Collection Act, and (4) the Rosenthal Act, depending on the state.

Eligibility:

You may be eligible if you received a Notice of Default (or Final Letter) and potential acceleration on their mortgage loans from Seterus, Inc. in connection with collateral property in the states of North Carolina, Michigan, Kansas, Alabama, New York, Minnesota, California, Missouri, Georgia, Florida, or Pennsylvania.

Typical Settlement Amount:

Amounts of payments will depend on the state class to which you belong. The Kansas, Alabama, New York, Minnesota, California, Missouri, Georgia, Florida, and Pennsylvania Classes are collectively called the FDCPA Class. Member of this class will receive different benefits from the members of the North Carolina and Michigan Classes because the state laws differ.
