Case Summary:

SeaWorld is paying $12 million to settle a class action claiming that it breached contracts when it automatically renewed EZpay contracts with passholders. The EZpay contracts allow consumers to make monthly payments for yearlong passes to SeaWorld theme parks. The complaint alleged that renewals in some cases also violated the Electronic Funds Transfer Act (EFTA).

Eligibility:

You may be eligible if 

  • You are a natural person who bought a one-year pass via SeaWorld’s EZpay program
  • To one of its parks located in Florida, Texas, Virginia, or California,
  • You were a resident of the state where the park is located at the time you bought the pass,
  • You bought the pass during the respective statute of limitations for the state, 
  • You paid for your pass in less than twelve months, and
  • You were charged additional monthly payments for renewal of the pass after you’d paid for the original pass in full. 
Typical Settlement Amount:

Estimated base payment for each passholder is $31.75. Final amount will vary depending on how many passholders exclude themselves. An extra $13 will be paid to each passholder whose payment SeaWorld took in violation of EFTA.

Total Settlement Amount: $12,000,000
