Eligibility:

You may be a member of the Injunctive Settlement Class if you received a call on your cell phone from Progressive Management Systems (PMS) between January 25, 2012 and October 16, 2017. This entitles you to injunctive relief, that is, PMS will stop placed automated calls to your cell phone. Also, if you choose to bring an individual lawsuit against PMS, PMS will not raise a defense about the type of dialing system used.

You may also be included in the Damages Settlement Subclass if the call you received from PMS between January 25, 2012 and October 16, 2017 was placed to your cell phone using LiveVox or TCN dialing equipment or artificial or pre-recorded voices messages, and your number was not listed in the patient or guarantor fields in the account in which calls were placed. 

Typical Settlement Amount:

No monetary awards for Injunctive Class members; for Damages Subclass members, a pro rata share of the net settlement fund. The final amount will depend on the number of valid claims submitted.
