Case Summary:

AmeriGas has decided to settle its part in a litigation against it and Ferrellgas, which does business as Blue Rhino. The complaint alleged that the two companies agreed to reduce the amount of propane gas in their pre-filled tanks from seventeen to fifteen pounds without lowering the price. This, the complaint alleged, improperly raised the cost of gas for the consumers who bought the tanks. The Ferrellgas portion of the litigation continues.

Eligibility:

You may be eligible if you are a member of either of these two classes:

Indirect Purchaser Class: All persons in the states below who bought an AmeriGas or Ferrellgas propane tank or who paid to exchange a propane tank for an AmeriGas or Ferrellgas propane tank, between December 1, 2009 and November 30, 2020, where the purchase was not a wholesale purchase directly from AmeriGas or Ferrellgas for resale. States: Arizona, California, Iowa, Maine, Michigan, Minnesota, Nevada, New Mexico, North Carolina, North Dakota, South Dakota, Utah, or West Virginia.

Direct Purchaser Class: All persons who bought, between December 1, 2009 and November 30, 2020, in the US, an AmeriGas or Blue Rhino propane tank directly from AmeriGas or Blue Rhino, through a vending machine at a retailer or other location, or who paid AmeriGas or Blue Rhino directly through such a vending machine to exchange a propane tank for an AmeriGas or Blue Rhino propane tank, other than as a wholesale purchase for resale.

Typical Settlement Amount:

Estimated benefits with proof of purchase: $5 per eligible tank, with no limits as to the number of tanks. Estimated benefits without proof of purchase: $2.50 per eligible tank, up to a maximum of fifty tanks. Payments will be made pro rata from the net settlement fund. Final amounts will depend on the number of valid claims submitted. If more claims are submitted than expected, amounts may be less.
