This settlement resolves a class action alleging that Postmates, Inc. violated the Fair Credit Reporting Act (FCRA) when it made background checks of individuals who signed up to be couriers using Postmates’ platform, but did not provide them with the disclosures and notices that the law requires. The complaint alleges that Postmates obtained the reports for employment purposes but did not provide applicants with (a) the legally-required disclosures, or (b) a copy of their consumer reports and a notice of their rights before taking adverse action against them.

Eligibility:

You may be eligible if you applied to be a courier using Postmates’ platform and Postmates performed a background check on you. There are two settlement categories, and the one you belong to will be determined by Postmates’ records.

  • Category 1681b(b)(2): All persons who signed up to be couriers using the Postmates platform between July 31, 2013 and May 1, 2016, who were subject to a background check procured by Postmates, not including persons who are Category 1681b(b)(3) settlement class members.
  • Category 1681b(b)(3): All persons who had unfavorable results in a Postmates’ background check and were not allowed to be couriers using the Postmates platform, between July 31, 2013 and September 24, 2015. 
Typical Settlement Amount:

For Category 1681b(b)(2) class members, payment is estimated as being between $14 and $25 if you file a valid claim form; for Category 1681b(b)(3) class members, payment is estimated as being between $42 and $75, and you do not need to file a claim form.
