Petco is paying over a million dollars to settle a class action that, when obtaining consumer reports on prospective employees, it violated the Fair Credit Reporting Act (FCRA) in two ways. First, the complaint says, it did not provide stand-alone disclosure that it was going to obtain the reports. Second, if it took adverse action on the basis of things contained in the reports, it did not first provide a pre-adverse action notification letter.

The Disclosure Class is all persons about whom Petco obtained a background report for employment purposes, between May 1, 2014 and December 31, 2015. The Adverse Action Subclass is all members of the above class against whom Petco took adverse action after getting a background report and who did not get a pre-adverse action notification letter. If you received a notice in the mail, you do not need to file a claim.

Typical Settlement Amount:

Disclosure Class members will receive an estimated $21 each; Adverse Action Class members will receive and additional estimated $150, for a total of $171. Exact amounts will depend on the number of valid claims received.
