Case Summary:

Precision Castparts Corp. and PPC Structurals, Inc. are settling a class action about whether operations at PCC’s Large Parts Campus interfered with the use and enjoyment of certain residential properties in Southeast Portland. The complaint alleged the facility emitted or deposited metals, including nickel, that were used in the process of making nickel-based superalloys, titanium, stainless steel, and aluminum investment castings, causing physical damage or “stigma” damage to the properties.

Typical Settlement Amount:

PCC has already spent $7.7 million on emission control against the kind of pollution at issue in this case, and it will spend $1.95 million more on pollution controls at its facilities. In addition, class members will receive cash payments from the net settlement fund. This money will be distributed according to a plan of allocation. All those living together in a single household must submit a Claim Form together in order to receive a payment.
