Case Summary:

A partial settlement has been reached in an antitrust litigation about packaged tuna with Tri-Union Seafoods, LLC, which does business as Chicken of the Sea International, and Thai Union Group, PCL (together referred to in this case as COSI). The complaint alleges that COSI and other companies unlawfully conspired to raise, fix, or maintain the price of packaged tuna products, in violation of antitrust and unfair competition laws.

This partial settlement settles claims against COSI only. Also named as defendants in the case are StarKist Company, its parent company Dongwon Industries Co. Ltd., Bumble Bee Foods, LLC, and its parent company Lion Capital (Americas), Inc. The case is continuing against StarKist, Dongwon, and Lion America; Bumble Bee is in bankruptcy.

Eligibility:

The COSI settlement class is all persons and entities who lived in Arizona, Arkansas, California, the District of Columbia, Florida, Guam, Hawaii, Iowa, Kansas, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Oregon, Rhode Island, South Carolina, South Dakota, Tennessee, Utah, Vermont, Virginia, West Virginia, and Wisconsin, who indirectly bought packaged tuna in cans or pouches smaller than forty ounces, for end consumption and not for resale, which were produced by any of the defendants in the case or any current or former subsidiary or affiliate thereof, or any co-conspirator, between June 1, 2011 to July 1, 2015. The class does not include purchases of meal kits.

Typical Settlement Amount:

Pro-rata share of the net settlement fund. The Claims Administrator will not distribute funds until all claims against the remaining defendants are exhausted. If no further money is recovered, it is estimated that claimants will receive roughly $10.50 for every 200 cans purchased (approximate number of cans if bought weekly during the class period). Payments of less than $5 will not be paid out.
