If you wish to be part of the FLSA settlement, you must submit an Opt-In Form (or opt in by one of the other means detailed in the FLSA Notice). To be part of the class action settlement, you do not need to do anything if you agree with the number of workweeks shown in the Notice you were sent. If you do not agree, you must submit a Dispute Form by October 11, 2022, with any supporting documentation you have.

Eligibility:

You may be eligible if you were an employee at Olam West Coast’s California locations in Fresno, Firebaugh, Hanford, Lemoore, Gilroy, or Williams, in a non-exempt or hourly non-exempt position, between July 7, 2011 and September 22, 2021.

Typical Settlement Amount:

Share of the net settlement fund, 75% of which will be allocated to the class settlement and 25% of which will be allocated to the class settlement. Your share will be based on the number of weeks you worked during the class period above as compared with the total number of weeks worked by all collective and class members.
Each payment will be considered to be 34% wages, which will be reported on an IRS Form W-2 and 66% as penalties, interest, consideration, and non-wage damages.
