Case Summary:

The NRP Group, LLC, NRP Management, LLC, NRP North Carolina, LLC, NRP Partners, LLC, NRP Alston Village, LLC (Falls Pointe at the Park), and NRP Alston Management, LLC are settling a class action alleging they violated the North Carolina Residential Rental Agreements Act, among other state laws. The complaint alleged that the companies unlawfully either charged or threatened to charge certain fees when filing eviction actions against tenants. The fees included complaint filing fees, sheriff service fees, and attorneys’ fees.

Eviction Fee Class members do not need to submit claim forms. However, anyone who wants to obtain benefits as members of the Collection Letter Class (including Eviction Class Members who are also Collection Letter Class members) must submit a claim form.

Eligibility:

You may be eligible if you belong to either of these classes: 

  • Collection Letter Class: Natural persons who, at any point between September 6, 2014 and June 25, 2018, lived at any of the properties owned or managed by the NRP defendants, and who received a letter that threatened that NRP would file a summary judgment ejectment lawsuit, an eviction action, or notice to vacate the premises if you did not make a complete rental payment, and that once the lawsuit was filed, you would be charged the eviction fees in order to dismiss the action.
  • Eviction Fee Class: Natural persons who, at any point between September 6, 2014 and June 25, 2018, lived at any of the properties owned or managed by the NRP defendants, and who were charged and paid the eviction fees. Eviction class members are also members of the Collection Letter Class.

Collection Letter Class: Up to $50-$150. Eviction Fee Class: Up to $700.
