Case Summary:

The Neiman Marcus Group is settling a class action alleging that it was negligent and otherwise in violation of its duties in the case of a recent data breach. In January 2014, the company announced that it had experienced a data breach that exposed payment card information of customers who had made purchases at several of its stores. The malware was said to have operated between July 16 and October 30, 2013, but only in some of its stores and often only part of the time the store was open. Of the more than two million payment card accounts that were used during this time, Neiman Marcus believes that only 370,385 were used while the malware was operating and claims that the other accounts’ payment information was not comprised.
