Case Summary:

Two more defendants have agreed to a settlement in a larger antitrust class action that alleges that natural gas companies conspired to manipulate the price of natural gas for commercial or industrial buyers in Kansas, Missouri, and Wisconsin between January 1, 2000 and October 31, 2002.

The companies that have agreed to this settlement are as follows:

  • CMS Energy Corporation, CMS Energy Resources Management Company (formerly known as CMS Marketing, Services and Trading Company), and CMS Field Services, Inc.
  • El Paso Corporation (n/k/a El Paso LLC) and El Paso Merchant Energy, L.P. (n/k/a El Paso Marketing Company, L.L.C.)

The case is continuing against the remaining defendants.

Eligibility:

You may be eligible if you were an industrial or commercial purchaser of natural gas who bought gas from sellers other than utilities or local distribution companies and you belong to one of the classes following classes:

Kansas Settlement Class: All industrial and commercial direct purchasers of natural gas for their own use, between January 1, 2000 and October 31, 2002, who used the gas in Kansas. Excluded from the class are (a) entities that purchased the gas for resale, (b) entities that purchased the gas for the generation of electricity for sale, (c) defendants and their associated companies, (d) the federal government and its agencies, and (e) Reorganized FLI, Inc. (formerly known as Farmland Industries, Inc.).

Missouri Settlement Class: All industrial and commercial direct purchasers of natural gas for their own use, between January 1, 2000 and October 31, 2002, who used the gas in Missouri. Excluded from the class are (a) entities that purchased the gas for resale, (b) entities that purchased the gas for the generation of electricity for sale, (c) defendants and their associated companies, (d) the federal government and its agencies, and (e) Reorganized FLI, Inc. (formerly known as Farmland Industries, Inc.).

Claim forms are not yet available and the claim filing deadline has yet to be determined.
