Case Summary:

UPDATE: On October 19, 2020, updates to this settlement were approved by the court. The updates provide extensions of time for filing a claim, request for exclusion, and objections. Also, if the total value of claims falls below the amount in the Common Fund, payments will be increased from 10% to up to 50% of the weighted average price of the products claimed. Additionally, it includes class statutes of limitations dates for class members in US territories.

If you have already filed a claim, you do not need to do anything. However, you may wish to amend your claim or withdraw your exclusion request.

ORIGINAL SUMMARY: Monsanto makes the weed killer Roundup. It is now paying just under $40 million to settle a class action alleging that the packaging for certain Roundup products contained a statement saying it “targets an enzyme found in plants but not in people or pets,” or the like. The complaint alleged false advertising, breach of warranty, and unjust enrichment.

Eligibility:

You may be eligible if you bought any of the products below, for personal or household use, during the class period for your state, and the product packaging contained the statement, “targets an enzyme found in plants but not in people or pets,” or a substantially similar statement.

Typical Settlement Amount:

Approximately 10% of the price of the products purchased during the class period. Without proof of purchase, you may make a claim for one unit per household per year during your state’s class period, except for the largest Roundup Weed & Grass Killer Super Concentrate product, for which you may make a claim for one unit every two years. You may make a claim for more than these limits if you have proof of purchase. Final amounts of refunds will depend on the total amounts involved in the claims filed.

Amounts may be increased or decreased, depending on the value of the claims received, to up to 50% of the weighted average retail price. Amounts of refunds range between 37 cents to $10.63 per product; maximum amounts are now $2.51 to $53.15.
