The Missouri Department of Corrections (MDOC) is paying just short of $50 million to settle an employment class action alleging it required workers in corrections officers I and II positions to do pre- and post-shift work without pay. The complaint alleged MDOC paid neither straight time nor overtime for this work. This settlement applies to all prisons operated by MDOC between August 14, 2007 and the present.

Eligibility:

You may be eligible if you are a Corrections Officer I or Corrections Officer II with the Department of Corrections of the State of Missouri, at any time between August 14, 2007 and the present for claims relating to unpaid straight-time pay, and between August 14, 2010 and the present for claims relating to unpaid overtime pay.

Typical Settlement Amount:

Settlement payments will be made according to a plan of allocation and will go out sixty days after the final approval hearing has taken place. (The hearing may be postponed or rescheduled without further notice; see the website to stay informed.) After checks have been mailed out, you may dispute the amount of your check, if you wish, by filing a Claim Form. The deadline for filing will be 11:59 pm PST forty-five days after receipt of the initial payment.

Also, beginning July 1, 2022 for the next eight years, through June 30, 2030, MDOC will add fifteen minutes per shift (only once in a twenty-four-hour period) to Corrections Officers I and II shifts to cover pre- and post-shift activities.
