Case Summary:Blue Cross Blue Shield of Michigan has agreed to pay out nearly $30 million to settle a class action alleging that it had “most favored nation” clauses in its contracts with 70 general acute care hospitals in Michigan. According to the complaint, these clauses violated antitrust laws and inflated the price of health care. This case reached a settlement in 2014, but it did not receive final approval.

Proof of Purchase:Insurers must provide proof of payment. The individual/consumer claim form says that claimants “may” be asked for proof at a later date.
Eligibility:You may be eligible if you are a direct purchasers of healthcare services from a Michigan general acute care hospital between January 1, 2006 and June 23, 2014. Included in the class are (1) individuals who made payments in the form of co-pays, deductibles, co-insurance, and so on, (2) insurers who paid bills for their insureds, and (3) self-insured entities whose health plan participants received care.

Typical Settlement Amount:Varies; those with small purchases may be given payments of $15 and/or $25. For those with larger purchases, the maximum payment will be 3.5% of the total purchases. The exact amount of the payments will be determined by which hospital received the payment, how much was paid, and which insurer was involved.
