Case Summary:

Daimler AG, Mercedes-Benz USA, LLC, Robert Bosch GmbH, and Robert Bosch, LLC are choosing to settle class actions against them regarding Mercedes-Benz or Sprinter BlueTEC II diesel vehicles in the US. The complaints alleged that the vehicles were equipped with improper emissions control systems that caused them to emit more nitrogen oxides (NOx) than permitted under federal and state clean air laws.

The EPA and California’s CARB have approved new Daimler-developed Approved Emission Modifications (AEMs) for some 188,000 vehicles and will be submitting other proposed AEMs for the remaining covered Blue TEC II vehicles in 2021. The AEMs are part of a consent decree with federal and California regulators.

Note that the deadline for claims for former owners and lessees is July 12, 2021, while the deadline for claims for current owners and lessees is October 1, 2022.

Eligibility:

You may be eligible if

- On or before September 14, 2020, you owned or leased and registered a Subject Vehicle, or
- After September 13, 2020, you began owning or leasing and registering a Subject for which an AEM has not been installed.

The class includes dealers and resellers who meet these criteria. Former owners and lessees are also able to make claims for payments. The Subject Vehicles include the following:

To be eligible to receive a payment, all class members must first have an AEM installed in their vehicles.

Benefits: (1) Free installation of AEM and extended warranty for it. (These are available from a Consent Decree with regulators, even if you choose not to participate in this settlement.) (2) Payment for current owners and lessees (up to $3,590) and former owners and lessees (up to $897.50). See the chart in the Notice. (3) Transportation expenses.
