Marietta Area Healthcare, Inc., which does business as Memorial Health System, Marietta Memorial Hospital, Selby General Hospital, and two individuals have agreed to settle a collective and class action brought under the Fair Labor Standards Act. Eligibility:

You may be eligible as a member of the Collective Class if you previously filed a Notice of Consent to participate in this case.

You may be eligible as a member of the class action if you are a current or former hourly employee, you were responsible for direct patient care, and you were subject to the automatic meal deduction policy, at any time between October 29, 2012 and December 31, 2018.

Typical Settlement Amount:

Class and collective members will receive $1.19 per shift, for the number of shifts worked during the class period in which you were subject to the automatic lunch deduction policy. Half of the amount will be considered wages and will be reported on a Form W-2 and subject to withholding; the other half will be considered as settling claims for penalties, liquidated damages, interest, and so on and will be reported on a Form 1099.
