Marathon Petroleum Corporation has agreed to settle a class action alleging that the company was negligent in not properly monitoring or maintaining the aboveground storage tank resulting in an explosion and fire on April 27, 2013, causing an alleged nuisance to people in neighboring areas. In addition to setting aside awards for class members, Marathon has redesigned and rebuilt the storage tank at a cost of $1,400,000 and modified another at a cost of $650,000

Eligibility:

You may be eligible if

  • You lived in Melvindale on April 27, 2013 within the specified area, but
  • You did not live in Melvindale, Ecorse, or River Rouge prior to August 27, 2001,
  • You did not live in the specified areas of South Dearborn or Detroit prior to August 27, 2001,
  • You were not a member of the class in the case Caines, et al. v. Marathon Oil Co., et al, Wayne County Circuit Court Case No. 99-940648-NZ, and
  • No member of your household has previously received a gas card from Marathon in connection with the April 27, 2013 incident.

Typical Settlement Amount:

Payment of $1,000 to each of the named plaintiffs in the case; also, a $100 Marathon gas card for each of the first 200 households to file a valid claim form. People who have already received a Marathon gas card following the April 27, 2013 explosion are not eligible to receive another gas card.
