Case Summary:Lemonade, Inc. and related companies are paying $4 million to settle a class action alleging the companies collected, stored, or used the biometrics of its insureds through its insurance software while making a video claim for loss. Eligibility:Two classes have been defined for this action:
- The Nationwide Class is all holders of policies of the Lemonade companies who, between June 25, 2019 and May 27, 2021, provided first notice of loss through a video claim submission from which the defendants or released parties in this case could have collected, received, or otherwise obtained or disclosed data or information that could be construed as biometric data or biometric information of any kind.
- The Illinois Subclass is all holders of policies of the Lemonade companies in Illinois who, between June 25, 2019 and May 27, 2021, provided first notice of loss through a video claim submission from which the defendants or released parties in this case could have collected, received, or otherwise obtained or disclosed data or information that could be construed as biometric data or biometric information of any kind.
Typical Settlement Amount:Pro-rata payment from the net settlement fund. The Illinois Subclass will receive 75% of the net settlement fund; the Nationwide Class will receive 25%. Lemonade has also stopped collecting biometrics and, upon approval of the settlement, will delete all previously collected biometrics.
