Case Summary:

IPEX, Inc. and its related companies are settling a group of US and Canadian class actions relating to their Kitec plumbing products and systems. The cmoplaint alleged that the systems and products were defective and prone to failures that might cause leaks or damage to surroundings. The products at issue may include components, parts, or systems, and may have been sold under other names, including PlumbBetter, IPEX AQUA, WarmRite, Kitec XPA, AmbioComfort, XPA, KERR Controls, and Plomberie Améliorée. You must prove ownership of the property as well as document any repairs for which you are seeking reimbursement.


You may be eligible if you are a person who has owned, leased, or have the right to pursue claims in the name of those who have owned or leased, buildings, residences or other structures in the US that contain Kitec systems made or sold by IPEX. 

The Clark County Class is excluded from this settlement. Also, this settlement does not cover personal injuries or certain claims against builders or plumbers for certain installation failures. Additional classes exist for those in Canada.

Typical Settlement Amount:

Compensation for repairs and damage. At this point, compensation is only for the repair of structures that have Kitec systems that failed. However, if you have a Kitec system but have not yet experienced a leak, you should still file a claim. After compensating those who have had failures, money may be left over for some compensation to those who have not yet had leaks.
