Case Summary:A settlement fund of $9 million is resolving a class action against JPMorgan Chase Bank, NA, JPMorgan Chase & Company, and others involved with the company’s 401(k) Savings Plan. According to the complaint, the defendants breached their fiduciary duties and engaged in transactions prohibited by the Employee Retirement Income Security Act of 1974 (ERISA) in their selection and monitoring of the plan’s investment options.

Eligibility:You may be eligible if you were a participant in or beneficiary of the plan, at any time between January 25, 2011 and the date on which the settlement receives final approval from the court, and your individual account funds were invested in one or more of the following funds:
- The Growth and Income Fund, the Mid Cap Value Fund, the Mid Cap Growth Fund, or the Small Cap Core Fund, but only if the investment occurred before December 19, 2015;
- The Core Bond Fund, but only if the investment occurred before March 12, 2016; or
- Any of the Target Date Funds, but only if the investment occurred before April 1, 2016.
Pro-rata share of the net settlement fund, distributed according to a plan of allocation taking into consideration the amount claimants invested in each of the disputed investments. Currently plan participants’ shares will be deposited into their accounts. Former participants, beneficiaries, and alternate payees will receive payment in the form of a check. If you would like to receive your payment as a rollover to a qualified retirement account, you must fill out and submit the rollover form found at the settlement website by September 12, 2020.
