Joya Communications Unwanted Text Messages TCPA Settlement

Settlement Structure: Claims Made

Active: Open

Case Summary:

Joya Communications, Inc. is settling a class action alleging it violated the Telephone Consumer Protection Act (TCPA). The complaint alleged that the company had sent consumers unwanted telemarketing messages to promote its mobile apps “Marco Polo” and “VideoKik.”

While the settlement was approved a long time ago, Joya was at the time a start-up that did not have the money to pay for the settlement. Instead, within four years, Joya was required either to create a settlement fund of $3.75 million or, if it were sold during that time, to pay 12% of the sale price to the settlement. Joya has now created the $3.75 million fund, which will be distributed to class members who submit valid claim forms.
