Case Summary:A partial settlement has been reached with some of the defendants in an antitrust case against pork producers, on behalf of direct purchasers of pork. Smithfield Foods, Inc., JBS USA Food Company, JBS USA Food Company Holdings, and Swift Pork Company have agreed to pay more than $101 million in a case alleging that a number of pork producers and others conspired and combined to fix or raise the price of pork products, beginning at least in January 2009, with the hope of increasing pork prices in the US.
The case is still going on against other defendants, including a number of other pork producers and Agri Stats, Inc.

Proof of Purchase:If you agree with the purchase information on page 2 of the Notice that was sent to you, you need only complete the Claimant Information on page 3 of the claim form, sign the attestation, and submit it by June 14, 2022. If you do not agree, or if you want to supplement your claims with data for 2020 and 2021, you should submit a Purchase Audit Request form along with your claim form. You should also submit any documentation you have to support your disagreement or 2020-2021 claims.
Eligibility:You may be eligible if you bought pork directly from any of the defendants, or their co-conspirators, or their respective subsidiaries or affiliates, for use or delivery in the US, between January 1, 2009 and January 12, 2021.
Typical Settlement Amount:The net settlement fund will be distributed to class members on a pro-rata basis, based on the amount of pork you purchased as compared to the total pork purchases of all class members.
